Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry has taken suo moto notice of deaths due to medicines provided by Punjab Institute of Cardiology (PIC), meanwhile Lahore High Court (LHC) has formed a judicial commission headed by Justice Aijaz-ul-Hassan to probe into the matter on request of Punjab government.

The Chief Justice has formed a bench led by Justice Tassadduq Hussain Jillani which will start hearing from today (Tuesday). The notices have been issued to attorney general, advocate general, provincial and federal health secretaries.

The Chief Justice Iftikhar Muhammad Chaudhry took notice on a note initiated by Justice Tassaduq Hussain Jillani, Judge Supreme Court regarding the news of the death of more than 90 heart patients under treatment in the Punjab Institute of Cardiology (PIC) allegedly on account of either spurious drugs or wrong prescription of blood thinning and lipid lowering medicines.

Taking a notice the Chief Justice has directed the office to register this note as petition under Article 184(3) of the Constitution, as prima facie it seems that provisions of Articles 9 and 14 of the Constitution have not been adhered to strictly.

The case be listed before a Bench headed by HJ (2) for 31.01.2012. Notice be issued to the Attorney General, the Advocate General Punjab, Secretaries Health of Federal Government as well as government of Punjab, PPO Punjab and D.G. FIA to appear and file reply of the petition.

Justice Tassaduq Hussain Jillani in his note has intimated, “The news of the death of more than 90 heart patients under treatment in the Punjab Institute of Cardiology (PIC) allegedly on account of either spurious drugs or wrong prescription of Blood Thinning and Lipid Lowering medicines has been noted with immense shock and concern.

After going through the note, the Chief Justice passed the order to register this note as Petition under Article 184(3) of the Constitution, to list the case before the Bench to be headed by HJ (2) for 31.01.2012 and to issue notices to Attorney General, Advocate General Punjab, Federal Secretary Health as well as Secretary Health Punjab, PPO Punjab and D.G. FIA to appear and file reply.

On the other hand Lahore High Court (LHC) has formed a judicial commission headed by Justice Aijaz-ul-Hassan to probe into the matter on request of Punjab government. The formation of the commission would be announced later.

LHC has ordered filing murder cases against those involved in spurious medicines in PIC.

During the hearing of a petition against Punjab Chief Minister Shahbaz Sharif regarding PIC deaths, Justice Umar Ata Bandial of Lahore High Court remarked that only case of negligence against the accused was not enough. He remarked that the CM has not been made the party in the case directly. He directed the petitioner to submit amended application.

Justice Bandial remarked that the corrupt people cannot be left free and nobody can be allowed to play with human lives.

On this occasion, Deputy Attorney General told the court that FIA has arrested owners of several pharmaceutical companies and licenses of different companies have also been cancelled.

Additional Secretary Health told the court that 46,000 people took medicines from PIC out of which 27000 belong to Lahore while 779 patients are admitted to hospitals.

Meanwhile, two more patients died due to PIC medicines in Services Hospital 60-year old Rahat Jahan and, 75-year-old Haji Yaseen have lost their live on Monday after using spurious medicines of PIC. Death toll of PIC free drugs has reached 114 now.

According to additional secretary health Punjab 779 patients are under treatment in different hospitals affected from reaction of medicines and Young Doctors Association (YDA) to call off strike.

The Young Doctors Association (YDA) had announced to observe strike on Monday in support of senior doctors who have been suspended by Punjab the Government after deaths from reaction of PIC drugs.

The YDA has announced that Out Patient Departments (OPDs) of all hospitals of Lahore will remain closed against transfer and suspension of senior doctors.

The association said that purchase and supply of medicine is responsibility of Punjab government and suspended doctors are not guilty.

The YDA had also demanded of the Punjab CM to resign by taking responsibility of the tragedy.
